The issue of which party or parties has(ve) standing to sue in adversary
proceedings has been hotly contested in a number of recent court decisions.
In reaching its decision that the trustee in Breeden lacked standing to
pursue the claims at issue, the Second Circuit had occasion to examine
and write about a number of important issues for litigants in adversary
proceedings.

Bankruptcy - Nuts & Bolts for Young Practitioners program, which was
filled to capacity at ABI's Annual Spring Meeting, is available online!
An outstanding faculty of judges and practitioners, led by ABI Resident
Scholar David G. Epstein, will explain the fundamentals of bankruptcy,
covering: structure of the Code; concepts such as discharge, property
of the estate, claims, priority, adequate protection; automatic stay and
exceptions; avoiding powers, fraudulent transfers, preferences; executive
contracts and leases; and chapter 11 from beginning to end. Faculty bios
are available online. The cost for this program is $295 (special prices
are available for government employees) and CLE credit is available in
some states.
